New Zealand Insitute of Legal Executives

1. INTERPRETATION

1.1 Definitions: In these Rules unless the context otherwise requires:

"Act" means the Incorporated Societies Act 1908;

"Council" means the Council of the Institute for the time being as appointed under clause 10 of the Rules;
"Councillor" means an elected or appointed member of the Council in accordance with clause 10 of the Rules;
"Executive Officer" means the Executive Officer of the Institute as appointed under clause 13 of the Rules;
"Institute" means The New Zealand Institute of Legal Executives Incorporated;
"Legal Executive" means a person who may or may not:
(a) be a Member;
(b) be in qualifying employment;
(c) have completed the New Zealand Law Society Legal Executive Course;
and is not a Registered Legal Executive;
"Member" means a Member of the Institute in accordance with clause 8 of the Rules;
"NZLS" means the New Zealand Law Society;
"NZLS Legal Executive qualification" means the certificaet attained upon completion of the New Zealand Law Society Legal Executive Course;
"President" and "Vice President" mean the President and Vice President of the Institute as appointed under subclause 10.1.4 of the Rules;
"Qualifying Employment" means employment by:

1(a) a lawyer; or
(b) a law firm incorporated under the Lawyers and Conveyancers Act 2006; or
(c) the legal department of any company, firm, government department, local or territorial authority, provided that the legal executive is under the direct supervision of the barrister(s) or solicitor(s) employed or retained by the company, firm, government department, local or territorial authority;
2  and who spends, on average, not less than 15 hours per week in the provision of legal services to clients that enables his or her employer to charge fees for such advice provided that this does not include a person employed for more than 30% of their working week as a secretary, typist, clerk of any description, trust accountant, office accountant, office manager or practice manager;
"Registered Legal Executive" means a voting Member who:
1(a) holds the New Zealand Law Society Legal Executive qualification or has before 31 December 2000 been exempted from holding it; or
(b) holds such other qualfication as may be approved by the Council from time to time; and
2(a) is in Qualifying Employment for 30 hours or more per week; or
(b) at the discretion of the Council, is in part-time Qualfying Employment being not less than 15 hours per week;
"Registered Office" means the registered office of the Institute as determined under clause 4 of the Rules;
"Registrar" means the Registrar of Incorporated Societies;

"Rules" means these rules;

"Seal" means the common seal of the Institute;
"Secretary" and "Treasurer" mean the Secretary and the Treasurer of the Institute as appointed under subclause 10.1.4 of the Rules;
"Voting Member" means an Affiliate, Associate or Fellow Member who holds a current registration certificate;

1.2 Headings: clause and other headings are for ease of reference only and shall not be deemed to form any part of the context or to affect the interpretation of the Rules;

1.3 Defined expressions: Expressions defined in the main body of the Rules bear the defined meaning in the whole of the Rules;

1.4 Clauses and sub-clauses: references to clauses and sub-clauses are references to clauses and sub-clauses of the Rules;

1.5 Plural and singular: references to the singular include the plural and vice versa;

1.6 Gender: references to one gender include the other gender;

1.7 Statutes and Regulations: references to a statute include references to any regulations, orders or notices for the time being in force made under or pursuant to such statute and references to a statute include references to all amendments to that statute for the time being in force whether effected by subsequent statute or otherwise, and references to a statute or provision thereof include references to any statute or provision for the time being in force passed in substitution for that statute or provision thereof.
